FlightDelayRepay’s Guarantee provides you with an automatic payment of £100 in the event that your Registered Flight is Delayed by three hours or more subject to the terms and conditions of our Guarantee as set out below.

Please read the terms and conditions below to understand when you will be entitled to receive a Guarantee Payment as these terms and conditions set out when we will pay a Guarantee Payment to you.
In this Guarantee the following words and phrases will have the meanings set out beside them:
Customer / you / your
means the individual who has been provided with cover under FlightDelayRepay’s Guarantee by a travel operator, travel provider, bank or card issuer or other authorised Provider of the Guarantee
A flight is delayed when it departs from its departure gate or stand three (3) hours or more after its scheduled departure time. The length of delay is calculated based on the difference between the scheduled departure time and the time that the Flight actually pushes back from the departure gate or leaves a remote stand if it is not connected to an airbridge (and not the time the Flight actually takes off). A Flight is not Delayed and you will not receive a Guarantee Payment where: (i) your Flight is rescheduled and there is a change of departure time and/or departure date regardless of the length of notice given to you of any such reschedulement (ii) your Flight is cancelled regardless of the time when you are notified of the cancellation (iii) your Flight leaves the departure gate three (3) or more hours after its scheduled departure time but you were unable to or did not board the aircraft (iii) you are removed or denied boarding your Flight but your Flight departs within three (3) hours of its scheduled departure time.
means Albania, Andorra, Armenia. Austria, Azerbaijan, Belarus, Belgium, Bosnia and Herzegovina, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Georgia, Germany, Greece, Hungary, Iceland, Ireland, Italy, Kazakhstan, Kosovo, Latvia, Liechtenstein, Lithuania, Luxembourg, Macedonia (FYROM), Malta, Moldova, Monaco, Montenegro, Netherlands, Norway, Poland, Portugal, Romania, Russia, San Marino, Serbia, Slovakia, Slovenia, Spain, Sweden, Switzerland, Turkey, Ukraine, United Kingdom (UK), Vatican City (Holy See).
means a flight which is scheduled to depart from or arrive at an airport in any country in Europe and for which the Customer has a valid ticket.
FlightDelayRepay / our / we / us
means Flightdelayrepay Limited a company registered in England and Wales with company number 10761573 and whose registered office is at 6 The Drive, Hale Barns, Altrincham, United Kingdom.
means the guarantee by FlightDelayRepay to pay the Guarantee Payment to Customers for Registered Flights which are Delayed and on the terms and conditions set out in this guarantee document.
means the sum of £100 per Registered Flight or such other amount or currency as may be specified in the Guarantee provided to you by your Provider.
means the period of coverage for a Customer pursuant to the Guarantee as agreed between FlightDelayRepay and the Provider from time to time.
means a travel operator, travel provider, bank or card issuer or other provider who is authorised by FlightDelayRepay to provide the Guarantee to its customers.
means a Flight which the Customer has registered on FlightDelayRepay’s website not later than 24 hours prior to the scheduled departure time of the Flight.
Under this Guarantee a Customer will receive a Guarantee Payment where a Registered Flight has been Delayed during the Guarantee Period.
2. Person in respect of whom payment is made
The Guarantee Payment is payable in respect of the Customer only and is not payable in respect of the Customer’s travelling companions unless those persons have their own coverage under a Guarantee. The Guarantee Payment will only be paid to a Customer and cannot be paid to any other person on the Customer’s behalf.
3. Flight Registration
Guarantee Payment will only be made in respect of a Flight which has been Delayed where the Customer has registered their Flight 24 hours or more prior to the Flight’s scheduled departure time. Where the Customer has not registered their Flight 24 hours or more prior to the scheduled departure time no payment will be made to the Customer under this Guarantee.
4. Determination of whether a Guarantee Payment is due
FlightDelayRepay uses data from FlightStats, who are the leader in flight data services, to determine whether a Flight has been Delayed and therefore whether a Guarantee Payment is due in respect of Registered Flights and this determination is final and binding save in the event of manifest error.
5. Payment of Guarantee Payment
FlightDelayRepay automatically instructs the payment of Guarantee Payments which are due to Customers and payment is made in accordance with paragraph 6 below.
6. All Guarantee Payments are made by PayPal
Where FlightDelayRepay has determined that a Guarantee Payment is due to a Customer then you will receive an SMS message to the mobile telephone number you provided when you registered your flight to confirm that a Guarantee Payment is to be made to your PayPal account. Payment will be made to the PayPal account linked to the email address you provided at the time of registering your Flight. Once payment has been made then PayPal will send you an email confirming the payment details. If you do not have a PayPal account then in order to receive the Guarantee Payment you will need to create an account once you receive an email from PayPal confirming that payment has been made.
7. Recovery of Guarantee Payments paid in error
FlightDelayRepay reserves the right to recover from You any Guarantee Payment that has been incorrectly paid to you and you agree that where you have received a Guarantee Payment in error or which should not have been paid to you that you will promptly repay those monies to us.
8. Confirmation that details provided are true and correct
By registering your Flight you confirm that the information you have provided is true and correct and acknowledge that providing untrue, incomplete or misleading information may lead to a Guarantee Payment being declined or being recoverable from you by FlightDelayRepay.
We aim to provide a first class and high quality service. If you are not satisfied with the service we have provided please contact us by email on email@example.com so we can deal with your complaint as soon as possible.
10. Cancellation and termination
10.1 You may terminate your coverage under the Guarantee at any time by contacting us by email using the contact details given at the beginning of this Guarantee. If you choose to terminate your coverage under the Guarantee prior to the scheduled departure time of a Registered Flight you will not be entitled to receive a Guarantee Payment in respect of that Registered Flight even if it is Delayed.
10.2 Unless you have terminated coverage under the Guarantee earlier by giving notice under paragraph 10.1, your coverage under the Guarantee will end when the Guarantee Period for which you have cover under this Guarantee comes to an end (for any reason, including as a result of the Provider choosing to no longer provide the Guarantee to you or its other customers).
11. Third Party Rights
This Guarantee does not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Guarantee. Only FlightDelayRepay and the Customer can enforce the terms of this Guarantee.
12. Choice of Law
This Guarantee is governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this Guarantee or its subject matter or formation.
